DATA PROCESSING AGREEMENT (DPA)
This Data Processing Agreement (“Agreement”) forms part of the Terms of Use between:
4-WEB.SITE (BALKANON 2024) – Platform Operator (Processor)andthe User / Business – Data Controller
and governs the processing of personal data in accordance with the General Data Protection Regulation.
- 1. Definitions
- For the purposes of this Agreement:
- Controller means the entity that determines the purposes and means of processing personal data
- Processor means the entity that processes personal data on behalf of the Controller
- Personal Data means any information relating to an identified or identifiable individual
Processing means any operation performed on personal data
- Data Subject means the individual to whom the personal data relates.
- 2. Roles of the Parties
The User / Business acts as the Data Controller
4-WEB.SITE acts as the Data Processor
The Controller determines the purpose of data collected through subdomains and booking systems.
The Processor processes data solely on behalf of the Controller.
- 3. Scope of Processing
- 4-WEB.SITE processes personal data only to provide platform services, including:
- website and subdomain hosting
- booking system functionality
- customer data storage
communication tools
analytics and system performance.
- 4. Categories of Data
- The Processor may process the following types of personal data:
- names
- email addresses
- phone numbers
- booking details
- service selections
communication content
technical and usage data.
- 5. Categories of Data Subjects
- Data subjects may include:
- customers of businesses
- website visitors
platform users
business representatives.
- 6. Processor Obligations
- 4-WEB.SITE shall:
- process personal data only on documented instructions from the Controller
- ensure confidentiality of data
- implement appropriate technical and organizational measures
ensure that authorized personnel are bound by confidentiality obligations
not use personal data for its own purposes except as permitted under the Privacy Policy.
- 7. Security Measures
- The Processor shall implement appropriate safeguards, including:
- encryption where applicable
- access control mechanisms
- secure hosting infrastructure
system monitoring and threat detection
regular updates and vulnerability management.
- 8. Sub-processors
- 4-WEB.SITE may engage third-party service providers (“Sub-processors”) for:
- hosting
- analytics
communication services
- infrastructure support.
- The Processor shall ensure that all sub-processors:
are bound by data protection obligations
provide sufficient guarantees of GDPR compliance.
- 9. International Data Transfers
- Where personal data is transferred outside the European Union, appropriate safeguards shall be implemented, including:
Standard Contractual Clauses (SCCs)
equivalent legal mechanisms.
- 10. Data Subject Rights
- The Processor shall assist the Controller in responding to requests related to:

- erasure
- restriction

objection.
The Controller remains responsible for handling such requests.
- 11. Data Breach Notification
- In the event of a personal data breach, 4-WEB.SITE shall:
- notify the Controller without undue delay
provide relevant information about the breach
assist in mitigation where possible.
- 12. Data Retention and Deletion
- Upon termination of services, the Processor shall:
delete or return personal data, at the Controller’s request
retain data only where legally required.
13. Audit Rights
- The Controller may request reasonable information regarding data protection practices.
- 4-WEB.SITE may satisfy such requests through:
- documentation
security summaries
compliance reports.
14. Liability
- Each party shall be responsible for its own compliance with applicable data protection laws.
- 4-WEB.SITE shall not be liable for:
- unlawful data collection by the Controller
misuse of personal data by the Controller
failure of the Controller to obtain proper consent.
- 15. Indemnification
- The Controller agrees to indemnify and hold harmless 4-WEB.SITE against claims arising from:
- unlawful processing of personal data
violation of data protection laws
failure to obtain necessary user consents.
16. Term and Termination
This Agreement remains in effect for as long as personal data is processed by the Processor on behalf of the Controller.
- 17. Governing Law
- This Agreement shall be governed in accordance with applicable laws, including those of:
- North Macedonia
Germany
and relevant European Union data protection regulations.
18. Priority
In the event of conflict between this Agreement and other terms, this DPA shall prevail with respect to data protection matters.
19. Acceptance
By using 4-WEB.SITE, the Controller agrees to this Data Processing Agreement.
Aggregated and Anonymized Data Usage
4-WEB.SITE may collect, process, and use data in an aggregated and anonymized form for business, analytical, and operational purposes.
Aggregated and anonymized data refers to information that does not identify any individual user or business and cannot reasonably be used to identify any person.
1. Creation of Aggregated Data
- The platform may combine and analyze data collected from multiple users and sources in order to generate statistical and analytical insights.
- Such data may include, but is not limited to:
- usage trends and patterns
- booking behavior statistics
- service demand trends
- performance metrics
- system activity data
anonymized demographic or geographic insights
interaction and engagement analytics.
- 2. Purpose of Use
- Aggregated and anonymized data may be used for the following purposes:
- improving platform performance and functionality
- optimizing user experience
- developing new features, services, or products
- conducting internal research and analytics
- generating industry insights and reports
business intelligence and strategic planning
marketing and promotional activities in non-identifiable form.
3. No Personal Identification
4-WEB.SITE will not use aggregated data to identify individual users or businesses.
All reasonable steps will be taken to ensure that such data remains anonymized and cannot be re-identified.
- 4. Sharing of Aggregated Data
- The platform may share aggregated and anonymized data with:
- business partners
- service providers
- analytics providers
affiliates
third parties for research or reporting purposes.
Such shared data will not contain personally identifiable information.
5. Ownership of Aggregated Data
All aggregated and anonymized data generated through the use of the platform shall be the exclusive property of 4-WEB.SITE.
Users waive any rights or claims over such aggregated data.
6. No Compensation
Users acknowledge and agree that they are not entitled to any compensation, rights, or claims arising from the use of aggregated or anonymized data.
7. Continuous Improvement Rights
The platform reserves the right to continuously analyze and utilize aggregated data to enhance its services, improve system performance, and support business growth.
Disclaimer of Warranties (As-Is Clause)
- 4-WEB.SITE is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
- To the fullest extent permitted by applicable law, the platform expressly disclaims all warranties, including but not limited to:
- implied warranties of merchantability
- fitness for a particular purpose
- non-infringement
accuracy, reliability, or completeness of content
uninterrupted or error-free operation.
- No Guarantee of Availability
- 4-WEB.SITE does not guarantee that:
- the platform will always be available or uninterrupted
- the platform will be secure or free from bugs, errors, or viruses
any defects will be corrected
services will meet user expectations or requirements.
- Third-Party and User Content Disclaimer
- The platform does not control and is not responsible for:
- content published by businesses or users
- accuracy of business listings or services
interactions between customers and businesses
third-party links or services.
Users access and use such content at their own risk.
No Professional or Legal Advice
Any information provided on the platform is for general informational purposes only and does not constitute legal, financial, or professional advice.
- User Responsibility
- Users acknowledge that they use the platform at their own risk and are solely responsible for:
- evaluating the suitability of services
verifying business information
ensuring compliance with applicable laws.
Governing Law and Jurisdiction
This Agreement shall be governed and interpreted in accordance with applicable laws, taking into account the operational structure of the platform.
- Dual Operational Structure
- 4-WEB.SITE operates through:
BALKANON 2024 (North Macedonia) – platform operator
Mile Trendafiloski (Germany, Berlin) – technical and operational support.
- Applicable Law
- Unless otherwise required by mandatory law:
disputes relating to platform usage may be governed by the laws of North Macedonia
certain operational or technical matters may fall under the laws of Germany, particularly where services are performed or infrastructure is located.
- Jurisdiction
- Users agree that any disputes arising out of or in connection with the use of 4-WEB.SITE shall be subject to the jurisdiction of the competent courts:
in North Macedonia, and/or
in Germany, depending on the nature of the dispute.
Platform Discretion
4-WEB.SITE reserves the right to determine the appropriate jurisdiction and legal framework for resolving disputes, where legally permissible.
Consumer Protection Exception
If the user is considered a consumer under applicable law, mandatory consumer protection laws of their country of residence may apply and override certain provisions of this clause.
Dispute Resolution
- Before initiating legal proceedings, users agree to attempt to resolve disputes informally by contacting the platform.
- The platform may, at its discretion, offer:
- mediation
negotiation
alternative dispute resolution methods.
Waiver of Class Actions
To the extent permitted by law, users agree that any disputes shall be resolved on an individual basis and not as part of any class, collective, or representative action.
Entire Agreement
These Terms of Use, together with the Privacy Policy, Payment Policy, Cancellation Policy, and any additional policies or legal notices published on 4-WEB.SITE, constitute the entire agreement between the user and the platform.
They supersede and replace all prior or contemporaneous agreements, communications, negotiations, or understandings, whether oral or written, relating to the subject matter.
Users acknowledge that they have not relied on any statements, representations, or promises not expressly set out in these Terms.
- Severability
- If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be:
modified to the minimum extent necessary to make it valid and enforceable, or
deemed severed from these Terms.
The remaining provisions shall remain in full force and effect.
The invalidity of one provision shall not affect the validity or enforceability of the remaining provisions.
Waiver
- Failure or delay by 4-WEB.SITE to enforce any right, power, or provision under these Terms shall not constitute a waiver of such right or provision.
- Any waiver must be:

issued by an authorized representative of the platform.
A waiver of any breach shall not be considered a waiver of any subsequent breach.
- Assignment
- 4-WEB.SITE may assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with:

sale of assets
restructuring of the business.
Users may not assign or transfer their rights or obligations without prior written consent of the platform.
Headings
Section headings are provided for convenience only and shall not affect the interpretation of these Terms.
Survival
- Any provisions which by their nature should survive termination shall remain in effect after termination of the agreement.
- This includes, but is not limited to:
- limitation of liability
- indemnification
- intellectual property rights
dispute resolution
governing law.
Electronic Acceptance and Digital Signature
- By accessing, registering, or using 4-WEB.SITE, users acknowledge and agree that their actions constitute a legally binding electronic acceptance of these Terms of Use, Privacy Policy, Data Processing Agreement, and all applicable policies.
- Users agree that:
- clicking “Sign Up”, “Create Account”, “Sign In”, “Continue”, “Book Now”, or any similar action
using the platform or its services
submitting information through the platform
constitutes a valid and legally binding electronic signature.
- Legal Validity
- This electronic acceptance shall have the same legal effect as a handwritten signature, in accordance with applicable laws and regulations, including:
- the eIDAS Regulation
applicable laws within the European Union
and relevant local laws in North Macedonia and Germany.
Consent to Electronic Communication
Users agree that all agreements, notices, disclosures, and communications provided electronically by 4-WEB.SITE satisfy any legal requirement that such communications be in writing.
- Record Keeping
- 4-WEB.SITE may maintain electronic records of:
- user registrations
- acceptance of terms
transactions and bookings
communications
which shall be admissible as evidence in legal proceedings.
- User Responsibility
- Users are responsible for ensuring that:
- they have the legal capacity to enter into agreements
the information they provide is accurate
they understand and accept the terms before proceeding.
Withdrawal of Consent
If a user does not agree to electronic acceptance, they must immediately discontinue use of the platform.
