PLATFORM TERMS OF SERVICE

Governing Language

These Terms and the related legal documents published by 4-WEB.SITE are drafted in English. Any translation or localized version is provided for convenience only. If there is any conflict, inconsistency, or ambiguity between the English version and any translation, the English version shall govern and control.

1.1 Acceptance of Terms

By accessing, browsing, registering for, or using 4-WEB.SITE, you confirm that you have read, understood, and agreed to be bound by these Terms of Use and all related policies referenced herein, including the Privacy Policy, Refund & Cancellation Policy, and any additional guidelines published on the platform.

1.3 Platform Nature and Role

• 4-WEB.SITE operates as a software platform and technology provider that enables businesses and service providers to create their own websites using subdomains and booking tools.
• The platform provides:
• website generator infrastructure
• hosting services
• subdomain website pages

booking system functionality

digital visibility and promotional tools.

The platform itself does not provide, sell, or deliver any services listed on supplier pages.

• All services presented on individual subdomain pages (for example: businessname.4-web.site) are offered and managed solely by the independent business operating that page.
• Businesses using the platform are considered independent service providers and are fully responsible for:
• the services they offer
• pricing and availability
• customer communication

safety and legal compliance

refund and cancellation policies.

• 4-WEB.SITE acts only as a technology infrastructure provider and shall not be considered a party to any agreement, transaction, or dispute between customers and service providers.
• Accordingly, the platform shall not be held responsible for:
• the quality or outcome of services provided by suppliers

any damages, injuries, or losses arising from such services

disputes between customers and suppliers.

• 1.4 Independent Businesses
• By creating or operating a subdomain website on 4-WEB.SITE, each business acknowledges and agrees that it is solely responsible for the following:
• The accuracy of all service descriptions published on their page.
• The legality of the services offered.
• Compliance with all local, national, and international laws.
• Maintaining any required licenses, permits, or authorizations.
• Providing truthful and transparent pricing information.
• Managing their own booking schedules and availability.
• Communicating directly with customers.
• Responding to customer inquiries and requests.
• Ensuring that services are delivered as advertised.
• Ensuring that staff or employees are qualified to perform services.
• Maintaining proper hygiene, safety, and professional standards where applicable.
• Managing refunds and cancellations according to their stated policies.
• Handling complaints and disputes with customers.
• Managing customer service and after-service support.
• Ensuring the safety of customers during service delivery.
• Ensuring compliance with consumer protection regulations.
• Complying with advertising and marketing regulations.
• Respecting intellectual property rights of others.
• Avoiding the use of misleading or deceptive information.
• Ensuring that images, videos, and descriptions posted are owned or legally authorized for use.
• Maintaining appropriate liability insurance where applicable.
• Paying all applicable taxes, including VAT or income tax.
• Issuing invoices or receipts where required by law.

Accepting full responsibility for all services offered through their subdomain page.

Accepting full responsibility for any damages, claims, or disputes arising from their services.

The platform 4-WEB.SITE acts solely as a technology provider and digital infrastructure platform and shall not be considered responsible for the actions, services, or conduct of independent businesses using the platform.

Any disputes, claims, damages, or legal matters arising from services offered by businesses remain the sole responsibility of the business providing those services.

Tenant Policies and End-Customer Disclosures

These platform Terms govern the relationship between 4-WEB.SITE and the tenant, business, supplier, or other entity using the platform. They do not replace the tenant's own terms, privacy notices, payment terms, cancellation policies, refund policies, consumer disclosures, or any other legally required documents that apply between the tenant and its customers.

Each tenant is solely responsible for preparing, maintaining, publishing, and keeping up to date all policies, notices, disclosures, and legal information required for its own business, services, jurisdiction, customer relationship, and payment or booking process.

If a tenant does not provide its own required policies, notices, disclosures, or legal information, the tenant remains solely responsible for that omission and for any resulting claims, losses, penalties, chargebacks, disputes, damages, liabilities, or regulatory consequences.

The tenant agrees to indemnify, defend, and hold harmless 4-WEB.SITE, its operators, managers, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses arising out of missing, inaccurate, outdated, incomplete, or non-compliant tenant policies, notices, disclosures, or legal information.

1.5 Eligibility

Access to and use of 4-WEB.SITE is permitted only to individuals and businesses that meet the eligibility requirements described below.

By accessing or using the platform, you represent and warrant that you meet all of the following conditions:

Age Requirement

Users must be at least 18 years of age or have reached the legal age required to enter into binding agreements in their jurisdiction.

Legal Capacity

Users must have the legal capacity and authority to enter into legally binding contracts.

Business Authorization

Data Accuracy

1.7 Subdomain Ownership and Rights

One of the services provided by 4-WEB.SITE is the creation of websites hosted under platform subdomains, such as:

• These subdomains allow businesses to create and operate their own online presence using the platform’s technology.
• Platform Ownership of Subdomains
• All subdomains created within the 4-WEB.SITE platform remain the exclusive property of the platform operator.

Users receive only a limited, revocable, non-transferable license to use a subdomain for the purpose of operating a website through the platform.

No Ownership Rights

• Businesses and users do not acquire ownership rights over:
• the subdomain name
• the hosting infrastructure
• the platform software

the website generation technology.

Subdomain Assignment

• The platform reserves the right to approve, reject, or modify requested subdomain names in order to prevent:
• trademark infringement
• impersonation of brands or organizations
• misleading domain usage

abusive or harmful content.

Restricted Subdomain Names

• Subdomains may not include:
• registered trademarks without authorization
• names of public institutions or government bodies
• misleading brand names
• offensive or illegal content.

Suspension or Removal

The platform reserves the right to suspend or remove a subdomain if it is used for:

illegal activities

fraud or scams

intellectual property infringement

harmful or abusive content

violations of platform policies.

Subdomain Transfer

Subdomains may not be transferred, sold, or assigned to third parties without the written approval of the platform operator.

Platform Control

The platform retains full technical and administrative control over all subdomains and may modify or deactivate them when necessary to protect the integrity, security, and lawful operation of the platform.

• Termination
• Upon termination of a user account or violation of platform terms, the platform may immediately suspend or remove the associated subdomain and website.
• Users acknowledge that the continued operation of any subdomain is dependent on compliance with these Terms.
• 1.8 Platform Availability

4-WEB.SITE strives to maintain reliable and secure access to the platform. However, the platform is provided on an “as-is” and “as-available” basis.

No Guarantee of Continuous Availability

• The platform does not guarantee that services will be:
• uninterrupted
• error-free
• secure at all times
• available at all times in all regions.
• Possible Interruptions
• Platform access may be temporarily unavailable due to:
• scheduled maintenance
• system upgrades
• server migration

infrastructure improvements

hardware or software failures

internet network disruptions

cybersecurity incidents

third-party service provider outages

data center disruptions

force majeure events.

• Maintenance
• The platform may periodically perform maintenance that may result in temporary service interruptions. Whenever possible, such maintenance will be scheduled to minimize disruption.
• Technical Dependencies
• The operation of the platform depends on external infrastructure including hosting providers, payment processors, internet service providers, and other third-party systems.

The platform shall not be responsible for service disruptions caused by such external providers.

Platform Changes

4-WEB.SITE reserves the right to:

improve or replace services

• Data Loss

Using the platform for illegal marketplaces

• Operating illegal service networks
• Engaging in fraudulent financial schemes
• Damaging the reputation of the platform
• Attempting to manipulate platform algorithms

Creating deceptive landing pages

Misusing platform infrastructure for unlawful activities.

Violation of this policy may result in:

account suspension

permanent account termination

removal of content or subdomains

• legal action where applicable.
• 1.10 Limitation of Liability
• To the fullest extent permitted by applicable law, 4-WEB.SITE and its operators shall not be liable for any damages arising from the use of the platform.
• No Liability for Business Activities
• The platform is not responsible for services offered by independent businesses using the platform.
• Types of Damages Excluded

The platform shall not be liable for:

Financial Losses

The platform is not responsible for:

terrorism

Maximum Liability

If liability cannot be excluded under applicable law, the maximum liability of the platform shall not exceed the total amount paid by the user to the platform during the 12 months preceding the claim.

• 1.11 Intellectual Property Rights
• All intellectual property rights related to 4-WEB.SITE, including but not limited to software, design, platform architecture, databases, algorithms, interfaces, graphics, text, logos, trademarks, and other digital materials, are owned by or licensed to the platform operator.
• Platform Ownership
• The platform, including all underlying technology, source code, and infrastructure, is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.
• Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform solely for the purposes intended by the platform.
• Restrictions
• Users may not:
• copy platform software

reproduce platform design

distribute platform technology

• modify or create derivative works
• reverse engineer platform systems
• decompile platform code
• extract or copy platform databases

attempt to replicate the platform functionality.

Trademarks and Branding

All platform branding elements including:

logos

• platform name
• visual identity
• marketing materials
• remain the exclusive property of the platform operator unless otherwise stated.

Users may not use platform trademarks or branding without prior written permission.

User Content

Users retain ownership of content they upload to their websites or pages, including:

• images
• text
• descriptions

marketing content.

However, by uploading such content, users grant the platform a worldwide, non-exclusive, royalty-free license to host, display, distribute, and process such content for the purpose of operating the platform.

Intellectual Property Violations

The platform reserves the right to remove any content that may violate intellectual property rights, including:

copyrighted materials

• trademarks
• proprietary content.
• Accounts involved in repeated intellectual property violations may be suspended or permanently terminated.
• 1.12 Indemnification
• Users agree to indemnify, defend, and hold harmless 4-WEB.SITE, its operators, managers, employees, contractors, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses arising out of or related to the user’s activities on the platform.
• Scope of Indemnification
• This obligation includes, but is not limited to:

• violations of laws or regulations

intellectual property infringement

misuse of the platform

• misleading or fraudulent business practices
• illegal services offered through the platform
• damages caused during service delivery
• violations of consumer protection laws

Legal Costs

Users agree to cover all reasonable legal expenses incurred by the platform in connection with such claims, including:

attorney fees

court costs

• settlement costs
• investigation expenses.
• Cooperation
• Users agree to cooperate fully with the platform in defending any legal claim arising from their use of the platform.
• 1.13 Force Majeure
• The platform shall not be liable for any delay or failure in performance resulting from events beyond its reasonable control.
• Such events may include, but are not limited to:
• natural disasters
• earthquakes
• floods
• fires
• pandemics
• epidemics
• war or armed conflict
• terrorism
• civil unrest
• strikes or labor disputes

government actions or restrictions

power outages

telecommunications failures

internet infrastructure disruptions

cyberattacks

failures of third-party hosting providers

• failures of payment processors.
• During the occurrence of such events, the platform’s obligations may be suspended for the duration of the event and for a reasonable recovery period thereafter.
• The platform will make reasonable efforts to restore services as soon as possible.
• 1.14 Modifications to Terms
• 4-WEB.SITE reserves the right to modify, update, or replace these Terms of Use at any time.

Reasons for Modifications

Updates may occur in order to:

comply with legal requirements

• improve platform functionality
• reflect technological developments
• address security concerns

adapt to changes in business operations.

Notification of Changes

Updated Terms may be published on the platform without prior individual notice to users.

Where appropriate, the platform may notify users through:

dashboard notifications.

• Continued Use
• Continued use of the platform after updated Terms have been published constitutes acceptance of the revised Terms.
• Users who do not agree with the updated Terms must discontinue use of the platform.
• 1.14 Termination and Suspension Rights
• 4-WEB.SITE reserves the right to suspend, restrict, or terminate access to the platform at any time if a user violates these Terms of Use or engages in activities that may harm the platform, other users, or the public.

• The platform may temporarily suspend a user account in situations including, but not limited to:

suspicious or fraudulent activity

security concerns

• misuse of platform features
• investigation of reported complaints
• violation of applicable laws or regulations
• abuse of booking or messaging systems.
• During a suspension period, the user may lose access to certain or all platform functionalities until the matter is resolved.
• Immediate Termination
• The platform reserves the right to immediately terminate accounts and associated services without prior notice if a user engages in serious violations, including but not limited to:
• illegal activities

fraud or financial scams

intellectual property infringement

• distribution of malicious software
• attempts to hack or exploit the platform
• impersonation of businesses or individuals
• operation of deceptive or misleading services

repeated violations of platform policies.

Removal of Content and Subdomains

Upon termination or suspension, the platform may:

remove or disable user-generated content

deactivate associated subdomains

suspend access to the website generator tools

restrict further use of the platform.

• Subdomains created within the platform remain the property of 4-WEB.SITE and may be reassigned or permanently removed at the discretion of the platform operator.
• User Termination
• Users may terminate their account at any time by discontinuing the use of the platform and requesting account deletion through the platform support channels.
• However, termination of an account does not relieve users from obligations incurred prior to termination.

Outstanding Obligations

Any obligations, liabilities, or legal responsibilities arising before the termination of an account shall survive termination.

These include but are not limited to:

payment obligations

dispute resolution

indemnification obligations

intellectual property obligations.

Platform Protection

The platform reserves the right to take any necessary action to protect the security, stability, and reputation of the platform, including the suspension or termination of accounts that pose risks to the platform ecosystem.
